ICE raids: Your rights if you are detained


ICE arrested more than 150 people "in violation of federal USA immigration laws" in the San Francisco Bay Area following Schaaf's warning, the agency said Tuesday.

Thomas Homan, U.S. Immigration and Customs Enforcement's acting director, told Fox News that the mayor's warning on Twitter was "beyond the pale" and compared her to a gang lookout who tells people when a police auto is arriving.

"Sanctuary jurisdictions like San Francisco and Oakland shield risky criminal aliens from federal law enforcement at the expense of public safety", ICE Deputy Director Thomas Homan said in a written statement.

The devastated wife of an undocumented immigrant whom federal authorities arrested this weekend condemned U.S. Immigration and Customs Enforcement (ICE) today, saying the agency misrepresented her husband's criminal past to justify his detention as an example to others here illegally.

Mayor Libby Schaaf had announced Saturday that she had learned through "unofficial channels" that the federal Immigration and Customs Enforcement agency was planning arrests in the area.

The warning "was meant to give all residents time to learn their rights and know their legal options", she said in a statement Tuesday night reported in the San Francisco Chronicle.

The ICE statement also called out sanctuary cities, including San Francisco and Oakland, as creating a danger for ICE enforcement agents and communities, and increasing "collateral arrests" of those not targeted by immigration officials. ICE activity creates anxiety in segments of our diverse community and when ICE alerts us about activity in our area, we are subsequently able to communicate with community stakeholders to quell, and not exacerbate fear in our city. President Donald Trump has held up the verdict as an outrageous example of how San Francisco's '"sanctuary city" laws fly in the face of public safety.

The new sanctuary law does not preclude local or regional law enforcement agencies from cooperating with ICE.

Leti Volpp, a UC Berkeley law professor, previously told The Daily Californian that those who may be affected by the ICE raids should remain silent, ask to speak with a lawyer and not sign any documents before first speaking to a lawyer.

She said the couple's daughter watched as agents put him in the back of their vehicle.

"Reports of abusive tactics by ICE are nothing new, they are part of a pattern of fear-mongering and retaliation", ACLU of Northern California attorney Angelica Salceda said.

ICE has sent repeated hard-line messages since President Donald Trump took office a year ago, declaring that undocumented immigrants should "look over [their] shoulder" and that politicians in sanctuary states should be prosecuted. "This raid was intended exclusively to terrorize innocent immigrant families and instill fear in the hearts of our communities - not to keep Americans safe".

Oakland's sanctuary city laws are some of the toughest in the country. Schaaf's warning was the boldest move yet by a mayor to counter the Trump administration's immigration-enforcement efforts.

People living near this downtown Stockton neighborhood say they saw ICE enforcement officers knocking on doors.

He said Schaaf is to blame for ICE agents capturing just 150 of the 864 undocumented immigrants they were seeking earlier this week, and he accused the mayor of putting agents in danger.

"Her statement at this time may have done more harm than help", he said. "Thanks to the dedicated and professional work of ICE deportation officers, we were able to remove many public safety threats from the streets of the Bay Area during the past few days".

Schaaf said the couple lived in Oakland and worked for 23 years to become legal residents.
